1. Provider
Pending legal configuration: The legal entity providing HospitalityOS, its registered address, and jurisdiction must be confirmed by qualified counsel before commercial launch.
2. Scope
These Terms of Service constitute a legally binding agreement between you and HospitalityOS concerning your access to and use of the HospitalityOS platform and website.
3. Account Eligibility
You must be at least 18 years of age and authorized to bind your organization to these Terms.
4. Organizations and Users
Organizations subscribe to HospitalityOS. Authorized users are invited by organizations. Organization administrators are responsible for managing user invitations and role assignments.
5. Subscription
Access to platform capabilities is governed by the subscription plan selected by your organization. Entitlements are checked server-side. If an entitlement is not active, the corresponding capability is unavailable.
6. Services
HospitalityOS provides property management, reservations, availability, operations, housekeeping, maintenance, guest service, commercial, intelligence, and optional Xperio3D spatial intelligence capabilities.
7. Customer Responsibilities
You are responsible for the accuracy of your data, managing user access, and using the platform in compliance with applicable law.
8. Acceptable Use
You agree not to misuse the platform. See our Acceptable Use Policy for details.
9. Hospitality Data
You retain ownership of your hospitality data. We process it only as necessary to provide the platform.
10. Guest Data
Organizations that process guest data are responsible for compliance with applicable privacy laws. HospitalityOS provides tools to help manage guest data.
11. Integrations
The platform may connect to external systems. You authorize such connections. We enforce fail-closed behavior for unknown credentials.
12. Xperio3D
Xperio3D is an optional extension. Spatial data does not contain guest PII. Spatial facts are presented with appropriate provenance and confidence.
13. AI Features
The platform includes AI-assisted features. AI does not replace human judgment. See our AI Policy for details.
14. Third-Party Providers
Third-party integrations are subject to the terms of the respective providers. We are not responsible for third-party service availability or quality.
15. Availability
We strive for high availability but do not guarantee uninterrupted service. Maintenance windows may be scheduled.
16. Intellectual Property
HospitalityOS retains all intellectual property in the platform. You retain all intellectual property in your data.
17. Confidentiality
Both parties agree to maintain the confidentiality of confidential information received from the other.
18. Fees
Fees are determined by your subscription plan. Pricing is confirmed during the sales process.
19. Cancellation
You may cancel your subscription at any time. Cancellation is non-destructive — your data is retained but entitlements are suspended.
20. Termination
We reserve the right to suspend or terminate access for violations of these Terms.
21. Warranty Limitations
The platform is provided "as is." We do not warrant that the platform will be error-free, uninterrupted, or fit for a particular purpose.
22. Limitation of Liability
To the maximum extent permitted by law, HospitalityOS shall not be liable for indirect, incidental, special, consequential, or punitive damages.
23. Changes
We may update these Terms from time to time. Material changes will be communicated through the platform.
